Imposition of sanctions

Entities that have entered into agreements with the Hellenic Capital Market Commission (HCMC), which are subject to the provisions of Chapter E of Law 4310/2014 (as amended by Articles 60–68 of Law 4982/2022, A’ 195), are obliged:

a. to provide immediately the accurate and complete information required by legislation on matters of radiation protection and radiological and nuclear safety, as well as

b. to respond accurately and comprehensively to enquiries submitted and information requested by the EEAE on matters falling within its remit.

In the event of refusal, obstructiveness or delay in providing the information requested, or the provision of inaccurate or incomplete information, the following administrative penalties shall apply:

  • A fine of up to 50,000 euros for each offence, without prejudice to criminal liability, and a report for the initiation of disciplinary proceedings against offending officials (for public sector bodies).
  • Revocation of approvals, authorisations or accreditations granted on the basis of inaccurate or incomplete information.

Furthermore, in the event of a breach of the Radiation Protection Regulations and the legislation in force on nuclear safety and the management of radioactive waste and/or the relevant regulatory acts that have been issued, the following provisions apply:

  • A warning and, in the event of non-compliance, a fine ranging from five hundred (500) euros to four hundred thousand (400,000) euros, depending on the risk posed by the infringement, without precluding the imposition of other penalties for the same infringement as provided for by other provisions.
  • Suspension of the operation of any installation using ionising or non-ionising radiation, or amendment or revocation of its authorisation, in the event of a serious breach of the Radiation Protection Regulations or the conditions of the authorisation, which causes or is likely to cause a serious risk of exposure to radiation.

It should be noted that, where applicable, pursuant to Article 67 of Law 4982/2022, criminal liability is also provided for entities that fail to comply with their obligations and the legislation in force.

With the aim of ensuring consistency and uniformity in the imposition of measures and sanctions in cases of breach of the Radiation Protection Regulations, the EEAE has developed a Compliance Action Model (CAM).
